This limitation of liability applies regardless of the legal theory under which the claim is brought, whether in contract, tort, negligence, strict liability, or otherwise, and even if Pizza Ranch has been advised of the possibility of such damages.

10.3 Class Action Waiver

Additionally, claims filed in small claims court are excluded from mandatory arbitration, provided they remain within the jurisdictional limits of such court.
